An Analysis of the Centre's FAQs on the 2021 IT Rules
The Ministry of Electronics and Information Technology ("MeitY") recently released FAQs on the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("2021 IT Rules"), with the objective of clarifying the scope of the obligations imposed upon intermediaries. This article provides an overview of notable clarifications issued by MeitY in the FAQs, examines some of the assertions made by MeitY therein, and identifies persisting ambiguities in the 2021 IT Rules.
