In furtherance of the objective of separation of powers between the Central Government and RBI regarding governance of capital account transactions, and subsequent to classification of capital instruments into debt and non-debt instruments, Central Government has come up with FEM (Non-debt Instruments) Rules, 2019. Separately, RBI has issued two regulations, FEM (Debt Instruments) Regulations, 2019 and FEM (Mode of Payment and Reporting of Non-Debt Instruments) Regulations, 2019.
Consequent upon issuance of the aforesaid rules and regulations, FEMA (Transfer of Issue of Security by a Person Resident outside India) Regulations, 2017 (Fema 20-R) and FEM (Acquisition and Transfer of Immovable Property in India) Regulations, 2018 stands repealed and substituted.
