The Ministry of Consumer Affairs, Food and Public Distribution recently notified the Consumer Protection (E-Commerce) Rules, 2020 (available here) (“Rules”). E-commerce has been defined in the Consumer Protection Act, 2019 (“Act”) as ‘buying or selling of goods or services including digital products over digital or electronic network’. The e-commerce related provisions of the Act (Section 2(16) and Section 94) were notified on July 23, 2020 (available here) and brought into effect from July 24, 2020.
The Rules apply to: (a) goods and services bought or sold over a digital or electronic network; (b) all models of e-commerce including marketplace and inventory models of e-commerce; (c) e-commerce retail, including multi-channel single brand retailers and single brand retailers in single or multiple formats; and (d) all unfair trade practices occurring on e-commerce platforms. The Rules also apply to an e-commerce entity which is not established in India, but systematically offers goods or services to consumers in India.

Advertisements: Sellers and inventory e-commerce entities must ensure that all advertisements depict the actual characteristics, access and usage conditions of the product or service.
Contraventions: The provisions of the Act shall apply for any violation of the provisions of these Rules.
While these Rules seek to cover the rights, duties and obligations of e-commerce entities and sellers, such entities must also comply with the provisions of the Legal Metrology Act, 2009, and rules thereunder, the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Information Technology (Intermediary Guidelines) Rules, 2000.
