As a first step towards implementing the Real Estate (Regulation and Development) Act, 2016 (“RERA”), the West Bengal Government on July 27, 2021, has notified the West Bengal Real Estate (Regulation and Development) Rules, 2021 (“Rules”).
This move by the West Bengal Government is in consequence of the decision of the Supreme Court in the case of Forum for People’s Collective Efforts v. the State of West Bengal, [Writ Petition (C) No. 116 of 2019, decided on May 4, 2021], wherein the Apex Court struck down the West Bengal Housing Industry Regulation Act, 2017 as unconstitutional.
